Banned+Deported from USA, Can i go to Amsterdam?

Post by Welshandy » Wed May 10, 2017 3:24 pm

Hi there,
(Sorry this is a little long and hopefully in the correct area)

Hopefully the subject says it all, but i will explain a little more..
in 2011 i had gone to texas,USA.. There are a number of reasons as to why i was out there.. (nothing to do with working there), Mainly because i had never been to america, i wanted to travel and visit everywhere.. i had a B1/B2 visa at the time and everything was going good. at the end of my stay i had got ready to go to the airport but missed my flight.. there was nothing i could do, i wasn't getting a refund and i had no money to get back as i was relying on my return ticket.
I had called up the US Immigration asking what could i do, i didn't want to illegally be there (i have a clean record, never broken a single law).. They said to find money and go home as soon as you can. i was in texas for 10 months all together. I had got together as much money as possible and just went to the airport.. i didn't have enough money for a flight but worth a try.. the airline wouldn't let me board.. so i tried another tactic and went to the Immigration commander at the time and spoke to her, she was very nice.. spoke to me nicely, treated me nicely.. and did everything she could to get me back to the UK, to which she eventually did (thankfully).. before i left, i asked her would i have any problem coming back into the USA because i accidentally overstayed, she said no, you will all good and shouldn't have any problems because it wasn't a long time overstay.

Late 2012, i wanted to go back to america (mainly because as i said, i like to travel.. and i didn't go to six flags and other parts of america).. but this time i was prepared.. i had plenty of money, i had all flights fully booked, travel sorted for other places. I had a stopover in new york before texas and thats when immigration pulled me into their little area and used their scare tactics to get information. to be honest, probably one of the meanest officers i've come across. he didn't want to allow me into the US, even though i had said, i have everything in order, showed evidence, made sure i wouldn't overstay and said i asked the commander in texas and she had said i wouldn't have any problems.

He decided to ban me from the US for 5 years and deport me on the next available plane.. (which seemed a little excessive since it was under a year and my first offence)..

basically, in June 2017, i want to go to amsterdam to a Festival with my friends (6 days Max), and i have a strong feeling that i'm going to be denied and i want a professionals input on the situation.. ( i have everything in order and all paid for).. i don't want to be denied infront of my friends and miss the festival, then be deported/banned from there too..
Will i be allowed into amsterdam because of my overstay in USA?

You have the right of entry under Article 5 and the right of residence under Article 6. However, these are subject to Chapter VI.

You say i have the right on entry, but is subject to that chapter.. which basically means they can deny me because i had overstayed? is that what it basically means?
Trying to get my head around all of this

I'm not sure if your overstaying, being removed and denied entry to the USA justifies a refusal under Public policy or Public security. They may or may not care. You should do more research. Does your current passport contain the USA's denial stamp? They may just look at your British passport and let you pass without any further checks.
