Tier 2 Established Staff to Tier 2 General

Hi All,

I came in to UK during Aug 2010 under ICT established staff and have continued staying in UK with ICT long term staff. I am working in an Indian IT service company and working for a UK organisation. I have couple of queries

1. Uk organisation is willing to offer me a job and Tier 2 General visa sponsorship can I switch from Tier 2 ICT to Tier 2 General and do I end up in cooling off issues and switching within UK issue?

2. I have checked the eligibility for Switch Tier 2 Visa in Gov.Uk and it has the Established staff category removed from Switching eligibility not sure when and how. I checked this during Jan 2017 at which time it had the eligibility but this has gone or disappeared. Section 254HD of immigration guidance still has the Established Staff in eligible criteria for leave to remain

So not sure if there is any changes in immigration rule and can experts please help me in undertstanding these rules better and point me in correct direction

Even I noticed that the Tier 2 Established Staff doesn't appear for switching to Tier 2 Gen in the following page https://www.gov.uk/tier-2-general/switch-to-this-visa

It was definitely there earlier and seems to have been removed recently.

Moderators can you please give us some opinion - can Tier 2 Established Staff switch to Tier 2 general in uk?

245HD. Requirements for leave to remain

(c) An applicant who has, or was last granted leave as a Tier 2 (Intra-Company Transfer) Migrant must:
(i) have previously had leave as a Tier 2 (Intra-Company Transfer) Migrant under the Rules in place before 6 April 2010, or in the Established Staff sub-category under the Rules in place before 6 April 2011,
(ii) not have been granted entry clearance in this or any other route since the grant of leave referred to in (i) above; and
(iii) not be applying to work for the same Sponsor as sponsored him when he was last granted leave.

I’m also in the same situation now. Did anyone switch to tier 2 general from tier 2 established staff recently?

If so, when did you start your visa process? I mean did you start your visa process when you were in notice period with your previous employer? Or started after relieved from them?
