Tier 2 extension in May 2018.

Post by sumannath » Mon May 15, 2017 2:48 pm

Hi All,

This is regarding my Tier 2 extension in May 2018. My current Tier 2 General Visa of 3 years was granted in May 2015 sponsored by XXXXXX, the company that I currently work for as a Graduate Electrical Engineer.

My main concern here is for Tier 2 extension I'll need an annual salary of at least £34.3k @37.5hrs/week (UKVI min. salary requirement is £35.6k @39hrs/week for SOC 2123) and I'm expecting my salary to be circa £28k @37.5hrs/week by then which doesn't meet the UKVI min. salary requirement which will be a big hurdle!

Could you please advise ways to get around this forthcoming problem; that I could discuss with the HR?

Many thanks and best regards,
Suman

Hi Suman,

The best case scenario is to extend your visa under different categories (like 2126 or 2129 etc) where Annual salary/income is low for experience workers (after fruitful discussion with HR/Employer). Which will also beneficial for you in your ILR application.

Hope, this will help.

Regards,
Mani

Hi,

Thanks for the reply. Will change of SOC mean company will have to do labour market test for me?

Best regards,
Suman

No at all. Shortage of Occupation refers to "Shortage of skills in UK". Therefore, no labour test is required if your category falls under SOC.

Hope, it will help.

I don't think his/her SOC refers to Shortage of Occupancy, but Standard Occupational Classification, which they do need an RLMT if you change it in most cases.
