Validity of Settlement Visa

Post by thotauk » Mon May 15, 2017 6:03 pm

I am a British Citizen, my wife lived in UK until 2009 then she moved to India due to health issues. In her passport it says that SETTLEMENT with valid until INDEFINITE.

Is her settlement visa stil valid or should we apply for a new one?

Please advise me.

Thanks,
Satish

Your wife will have to re-apply for a Spouse Settlement visa, meeting all the conditions under the current Immigration Rules. Her ILR was lost once she spent more than 2 years outside of the UK.

If the spouse visa is granted she will be on a new 5 year path to ILR (2.5 + 2.5 years)
