UKBA Premium Service failure, my wife is now illegally here

Post by Ryan91 » Mon May 15, 2017 7:51 pm

Good Afternoon all,

I'm really struggling to get anywhere with the UKBA. Everyone we speak to redirects us elsewhere and no one wants to give me the contact information for the correct department we need so I'm hoping someone may be able to offer advice.

So here's our problem:
My wife recently applied for the leave to remain visa and with a family holiday arranged in July we didn't want to risk any delays so we opted for the Premium service at Croydon's premium centre.

All ran smoothly in Croydon and we received confirmation of her additional 30 months being granted, however, the biometrics card that arrived on Friday has the wrong 'valid until' date. Instead of being valid 30 months from the beginning of May 2017 it is actually valid until 15.05.2017 (today)!

This now means that my wife is now here illegally (I gather this biometric card now overrides her previous visa?), she may be suspended from her job because of this and our holiday to Portugal is now very unlikely.

Naturally we want to get this sorted as soon as possible but the UKBA have been very lackadaisical in their response and every department tell us that they can't help.

Has anyone else had an issue with admin errors? And if so how did you resolve the issue?
Also, do we have any chance of a refund for the premium service charge?

Thanks in advance for any help.

Ryan and Natalia.

Also, we emailed the 'admin review team' and even they are saying it isn't their department as they only deal with people who contact them in regards to a failed bid.

Dear Ryan & Natalie...firstly rest assured that your wife isn't here illegally.

Have you followed the instructions in this link regarding reporting an error in the BRP ?

https://www.gov.uk/biometric-residence- ... rt-problem

When did your wife receive her BRP? An error should be reported within 10 days, although I realise this is what you've been attempting to do without any success.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Hi Casa,

Thanks for your reply and for putting our minds at ease.

We actually collected the Biometrics permit from the DX collection point as we had a couple of failed deliveries but it was issued on the 04.05.17 and we reported it yesterday (14.05).

Now our main concern then is the holiday - we go on the 8th July but, we also need to apply for a schengen visa for this as it is in Europe.

A simple error for them is a massive hindrance for us and no one at the UKBA seems to want to assist. It's a great shame.
