Status of employment effect on Tier 4

Post by deput7 » Wed May 17, 2017 2:01 pm

I have a query regarding how current employment status affects TIER 4 visa.

I and my wife will have to apply for a Tier 4 visa in August. We got admits from two universities to do MSc Program. I am working in UAE and will complete my notice period next month following which I will apply for the visa from India. Since I will not be employed during the visa application, how will that affect my visa application?

I have more than enough funds from my savings (Tuition & living) for my education. My father is willing to give me a sponsorship letter as well. My wife's expenses will be taken care of by her parents supported by corresponding bank documents.Included my wife's details just to put things in perspective that although we will be travelling together our intention is purely to study and return to India upon graduation.

Kindly advise how employment status affects the visa process and how can it be genuinely justified?

It has no relevance or bearing on your Tier 4 application.

If you are showing all the required funds in your own name, your father's funds are not relevant to your Tier 4 application.

Her parents will need to transfer the money to her (or to you) in enough time for her to show the money held for 28 days. Dependants can only show evidence of money held in their own name, or in the main applicant's name, not in anybody else's name.

I advise you check on the actual requirements for a Tier 4 application, as you seem to have some mistaken ideas about what is required. See https://www.ukcisa.org.uk/Information-- ... quirements

Okay. Thanks for that info.

I have one another query.

Last month my company stamped my visa a three days late.
The visa expiry was on a Friday. Since it is a public holiday on Friday and Saturday it took them till Tuesday to stamp my visa. So, when I apply for my visa from India after a month, while completing the travel history section would it create any problem related to overstaying a visa. Is this considered as overstaying a visa? I've never over stayed a visa anywhere.

Kindly advise.

The work visa I'm on expired last month and my company stamped it 3 days late. Would this be considered as overstaying?

No one here has any insight into the immigration rules of the UAE. I advise you ask about that locally.

What I meant while applying for a Tier4 visa would the fact that my visa was stamped late in UAE have any bearing on tier 4 Visa application? Would UK VO take it as a case of overstaying?

I strongly advise that you check the eligibility criteria for a Tier 4 visa, rather than asking about random aspects of your life and whether they have any bearing on the application.

So far I meet all the requirements meeting the eligibility criteria for Tier 4 visa.
- Required Funds.
- CAS conditions met
- My Canadian student application was refused 3 years ago due to insufficient docs and funds. Have the refusal letter copy to attest to that.

Had to raise the previous query due to having read somewhere that overstaying any visa anywhere is a red flag in visa applications although in my case I didn't actually overstay only that my company was late to stamp the visa.
