We have applied for FLR(FP) on the basis of Private Life and Parent. I am a British Citizen, my husband is Indian. The HO said that we was allowed to get married after we had a meeting in regards to how 'much we know each other', cannot remember what the process is called as it was a while ago now, even though we got married in January this year.
My husband came to the UK on a student visa, and in 2002 he tried to extend his student visa but it got rejected and he never bothered to appeal, and left it at that - he has been illegal ever since because he had no grounds to stay, despite seeing 3-4 solicitors, they all said he has no grounds of stay here and his application would be rejected immediately.
We have been together and lived together since 2012. He continued living illegally because when we saw a solicitor, they said I do not meet the financial threshold to support him and have an application to be made.
As of now, we have a baby together who is born and bred here in the UK. When I found out I was pregnant last year, we immediately went to see an immigration solicitor who advised us appropriately. He said that we should apply for a fee waiver but it will most definitely get rejected, however this will by us time until I have had the baby. About 2 weeks before my son was born, we got the letter from HO stating that his application has been rejected on the basis that the HO has decided we can afford the HO fees (we knew that it would be rejected).
My husband has now applied for the FLR(FP) application again (on the basis of partner, private and family life) which was in November last year, and he has also paid the NHS fee around February this year. We are currently still awaiting for a decision. We sit in fear every day wondering whether they're going to reject him! What are the chances of this actually happening? I mean, he is technically still illegal so will this go against him? We sent all of the necessary documents and what the HO and solicitor has asked us to do, we have done. The solicitor said we just have to sit and wait
