Hi all,

I am new on here and apologies if this has been posted and answered elsewhere on the board.

My situation is slightly different to the original post - I am a Namibian national currently in the UK on a EEA Family Permit (Unmarried) and have been living in the UK for the last 3yrs with my Romanian partner. We met when we both lived in the Republic of Ireland and have a 4yr old son who is an Irish national.

Shortly after the birth of our son my partner started drinking a lot and within months of moving to the UK he started becoming physically, mentally, and emotionally abusive. 2yrs ago I reported him to the police and shortly after that he started threatening to take our son away moving back to Romania and never seeing our son again by having me deported back to Namibia as my status here in the UK is solely dependant on him.

Since then, I have lived in fear of going to the police and the domestic abuse has got worse but can't report him as I'll lose everything. But I am now at a point were I feel enough is enough and I need to do something for the safety of me and my son. May someone please advise me on what I can possible do and what my immigration options are? I cannot afford to get a solicitor as I cannot afford one due to my partner making sure I am financially dependant on him by making me stay at home looking after our son whilst he works.

I'd like to lawfully stay in the UK as I have family (two brothers and a sister) who live here. May someone please advise me what my visa/immigration options are??

You should report him and apply for residency status under domestic provision.

Hi Obie,

Thank you for the quick reply, really appreciate!

I reported him 2yrs ago and was released with just a caution with no further action, and now I'm afraid if I report him again he will disappear with my son like he promised. Is the initial police report enough? Also would I be better off submitting a single application because my son is an EU national, or should I include him as my dependant?

You must not only report him this time but also apply for an exparte Non-Molestation order, so as to prevent him from coming anywhere near you or your child, and then apply under the domestic violence provision.

Hi again all,

I'm back here for more advice as my situation has moved from bad to worse, and I hope someone can advise me on the best options.

Since I was last on here I took the advice and reported my partner to the police who attended the house following a domestic abuse incident. The asked me to leave the house for the night and took me to my brothers house, I was promised a follow up on the matter but since then I have had absolutely nothing or heard back from them. I have tried to contact the National Domestic Violence Helpline but can never get through for assistance and guidance. So right now I feel very helpless as the police won't help me and I do not know what else to do.

But my situation gets worse and I am seriously panicking. About a month ago I stupidly slept with a close friend who I confided in with about my situation and I've recently found out that I'm pregnant. He has been very supportive and wants me to keep it but I honestly don't know what to do as I feel this will only complicate my visa situation even further!? I'm currently in the UK on EEA Family Permit (Unmarried) with an abusive EU citizen partner, and now pregnant with a child who will be born to a British citizen father. My current relationship has broken down, and I'm now pregnant to someone who wants to be part of their unborn child's life. Do I need to notify the UKVI, and will they deport me considering my son is an EU citizen? What are my options based on my current situations?

I'm really thankful for any guidance and advice please.
