URGENT: Tier 2 Sponsor Visa

Hi

I have a situation, I currently applied for Tier 1 50K extension visa and currently waiting for the decision, in the meanwhile I applied for a Tier 2 sponsored job as well which I have now been offered, The company has got a COS available after they did the RMLT by advertising the job for 1 month and after conducting several interviews I have been offered a job.

The problem is, my currently visa is with Home Office for extension and the company who offered me the job did not as yet assigned the COS against my name, they are waiting for me to get my documents back from Home Office.

I have a few questions:

1. How long the Home office considers the validity of job advert and COS (since my Tier 1 Ext decision might take another 2 months to come back and the employer who has offered me job can wait until another 3 months for me, after that they will aithdraw their offer)

2. In case my Tier 1 Ext is rejected, can i still shift to this Tier 2 Sponsor Visa with RMLT and COS already done.

3. In case it takes long with Tier 1 Ext result and the company offering me the job can wait to hire me, do they have to advertise the job again and do the RMLT again ? if that is the case, when they have to do that (The original job was posted on 5th April and job application adverts expired on 5th May 2017).

I hope the senior members and everyone who has knowledge will answer this ASAP.

1. 6 months
2. Possibly yes, if you apply within 14 days of rejection
3. as number 1

You could ask them to issue u a cos, and u should vary your application to tier 2, so you could even get the refund for the original application.
this can only be done if u apply before the decision on your current application is made.
