overseas employee related

Post by onewin » Fri May 19, 2017 11:06 am

Hello All,

My friend run a export business, he exports products in Asian countries.
As he cant fly frequently, he employed a uk citizen there.

My point is as per guideline we can only hire employee in uk as a part of job creation.
but he says he is paying all taxes n salary here in uk as per uk government laws then he can show that employee under job creation.

please advice us.

There is no objections in the rules under the definition of settled person.

He also said same. but my point was in guideline it says as :

"taken over or invested in an existing UK business or businesses; and your services or
investment have resulted in a net increase in the employment provided by the
business or businesses for persons settled in the UK by creating the equivalent of 2
(or 10 if applying for accelerated settlement) new full-time jobs. The jobs must have
existed for at least 12 months during your most recent grant of leave unless you
entered the route before 6 April 2014. More details on the requirements for employing
settled workers can be found in the previous section on extension applications."

I REPEAT AGAIN, the definition of SETTLED in the Tier 1E rules simply means citizens of certain counties or people with ILR, nothing more nothing less.
