SET(LR) form question D6 & Student Industrial Placement

Post by mithralaya1 » Mon May 22, 2017 9:16 pm

Hello,

I am going to apply for 10 year ILR in couple of weeks time.

I am preparing my application form and one of the questions is,

Have you ever worked in the United Kingdom without immigration permission to do so
(that is, contrary to your conditions of stay)?
  • - Yes
  • - No
And a box to explain why I took employment

My degree requirement was to take up industrial placement(Inside UK) during my student visa times, and this was part of my degree to satisfy my grades.

So far Home office haven't questioned me on this particular thing whenever I made further applications(PSW and Tier 2).
  • - Should I tick YES or NO?
  • - What should I explain in the box provided?
  • - What kind of documents should I submit with the application to prove this (I have Degree certificate & Transcript)?
Many thanks,

Hi,

I believe your response should be no as the placement was part of your degree criteria. I don't believe that you placement was contrary to the condition of you visa except if otherwise. Any attempt to answer yes may result to automatic refusal as it will appear that you have breach the condition of you visa. I will advise that you recheck your student visa offer letter
to ascertain the fact.

SET(LR) form first page warning

Post by mithralaya1 » Tue May 23, 2017 2:29 pm

Hello,

Came across this massive warning on the first page of SET(LR)

DUTY TO STATE ALL REASONS TO REMAIN IN THE UNITED KINGDOM
All your reasons or grounds for wishing to stay in the United Kingdom must be
stated in this application. This requirement is being given under section 120 of
the Nationality, Immigration and Asylum Act 2002. If you do not tell us now of any
reasons or grounds for remaining in the United Kingdom and you tell us later without
good reason, you will lose any right of appeal you may have otherwise qualified for if
we refuse your claim. You can use the box at the end of section 3.2.
But when I checked Section 3.2 it says ,

3.2 . If you have not obtained one of the relevant qualifications, are you claiming exemption
from this requirement because a physical or other condition prevents you from taking the
Life in the UK test or doing a speaking and listening qualification in English? YES or NO
I found another place in Section 2
D15. If you have any reasons or grounds for wishing to stay in the United Kingdom which you
have not already mentioned in your application you should do so now in the box below.
QUESTIONS:
  • - Where actually should I enter that information required? and
  • - What should I write as my reasons or grounds for remaining in the United Kingdom?
Many thanks,

There is no need to state anything explicitly unless you also have human rights concerns. Settlement with 10 year private life in the UK is accepted under SET(LR) by definition

Likewise, i cannot find any space for entering these info that the end of section 3.2. There is only a field to state the reason in D15 but that's only for EEA nationals. Please shed some light on this - seems to be confusing.
