Future spouse refused entry-help would be greatly appreciatd

Hi folks,

My fiancé (Brazilian) was turned away/refused entry when returning to Dublin airport a couple of months ago for overstaying – she left willingly to limit the impact. We’re now planning to get married abroad in a few months.

We’re very concerned that she might be refused entry again even with a marriage certificate and other documents proving that we’ve been in a relationship for over 3 years.

I have a few questions that I’d really appreciate help with:

1. Is there any way to find out if she will be refused again? (I emailed inis but got an automatic response saying that they might not reply - they haven't replied yet. I also got in touch with Garda immigration in Dublin airport and they directed me back to inis – I was told to email them again. There doesn’t seem to be a phone number for inis.)

2. Can we apply for permission to reside in the State on the basis of marriage while she is on a tourist visa? (The following quote from the inis website doesn’t clear things up for me because it specifically says ‘except short stay’ visas but does that relate to the 1st part of the sentence!???: “If you are a non visa required national who has entered the State legally within the last 90 days or if you are a visa required national and you are within the period of permission to remain granted to you on arrival in the State (except short stay ‘c’ visas)…” http://www.inis.gov.ie/en/inis/pages/wp07000024 ). Ideally we’d like to start the application immediately when we get back and have it processed before the 90 days expire.

3. Has anyone else been through something similar?

Again, I’d really appreciate any help/insight.

(I’m an Irish national btw and apologies for the long post)

Hi James,

Sorry to hear that.

Once you are legally married they won’t refuse her entry, please make sure you travel with her and have your marriage certificate with you at Dublin airport. Also if the marriage certificate is in other language than English please have a certified translation of it with you.

Once she’s in the country:

- If you are based in Dublin book an appointment for Registration and go there with your wife, bring her old and new passports, marriage certificate and proof of address the day of the appointment. The officer will place a Stamp 4 on your wife’s passport and will issue her a GNIB card.

- If you are based outside of Dublin you will need to assist your local Garda station, check with the local Garda officer what documentation they need.
