FLR (FP) advice

Post by Rozzers » Fri May 26, 2017 1:52 pm

Hi there,

I am British, my wife is from Hong Kong, and my 3 children are British (1 born here, 2 born in Hong Kong). 2 children are school ages and at school, one is only 2 years old.

My family returned to the UK in July 2015 to settle down. My wife is here on the FM (spouse) visa, which is due to expire in Jan 2018. We meet all the criteria to extend that visa when the time arrives. We are not on the poverty line, but we are still losing money each month on living costs here.

However, I have been offered a job back in HK on a 2 year contract to start in August for a lot more money than what I am on here. I have been advised that I should take the job and apply for a FLR (FP) for the wife to stay here and take care of the settled children. I know the argument is that they can join me in HK as that is where she is from and where the children have lived before, but they are settled here, in school and doing well, and we don't want to move them. Some immigration firms have said it is likely it will be successful, but I am not so sure.

Can anyone offer some advice if I have a case? Or what is the best option?
