Maternity Leave-Visa TIER4 Expires during maternity licence

Hi,

I am currently a TIER 4 visa student. My wife has a TIER4 general dependant visa. Our VISAS expire next January 2018.

My wife has been working from November 2017, and now she is pregnant. I have read that she can get the maternity leave, but I would like to resume the next information and ask you next question:

*The due date for the baby is 11 December 2017.
*Our Visa expires January 2018.
*Our idea is to leave UK before the due date and stay more than 6 months in our native country, maybe we will not come back to UK.
*Can my wife get the maternity leave?
*Can she receive payments during the maternity leave?.
*What happens if her visa expire in January 2018 and the maternity leave would cover a longer period? in that case, can the VISA status affect the maternity rights?

November 2016 I assume you mean.

For maternity leave that would be another forum but I would assume that is for a company's discretion. Certainly you will need to leave the UK when your Visa's expire, and you will need to see if that will impact on your wife's Maternity Leave. I believe it will - idea of Mat leave is that the staff member returns to work after.
