Tier 2 General Salary Calculation

Hi
i applied for Tier 2 general visa in country extension and my employer issued cos showing salary GBP34000.00 per annum and working hours 42.

But as per my SOC code 3545 Sales accounts and business development managers Salary requirements for extension is Experienced worker: £33,300.

Just now i found out this minimum salary requirements is for 39 hours so will they calculate my salary pro rata basis.

So my application will be rejected????

39/42*34k = 31571 less than required. So yes, this can/will be rejected.

Dear I worker

Thank you very much for reply.This is totally mess up from my HR dept. They calculated hours wrongly. My actual hours are 38.50 according to contract.

My AO informed homes office via sms that salary is for 38.50 hours not 42.00.

My solicitors is saying, if its refused we will make Administrative review application.

Kindly advise what are the chances are for success of admin review.

or should i reapply again straight???

Do my employer have to issue new cos or he can Amend details in current cos ??

If your employer has added the note in the cos before the application has been looked at, then maybe there could be some success at AR if rejected.
