MN1 section 3(5) application

Post by yossarian » Tue May 30, 2017 1:46 pm

Hi all

We just got FLR M on Friday for my unmarried partner and children (yay :D ). I'm now thinking about the next stage which for us is a MN1 application for my children under section 3(5). We can do this from October this year once we have all been living here for three years.

(NB I am a British citizen by descent, and my partner and children are all NZers, we arrived Oct 2014).

A few initial questions that are worrying me.

1. the MN1 form seems to request a full travel history of the children (this is easy enough), but also me (question 3.3). This is more challenging as I have made a lot of business trips to Europe over the last 2.5 years, probably a few dozen. Do I really have to declare all of these? Will it affect the application if I miss some out or if some dates are wrong (I'm not sure I can get to 100% accuracy as my records aren't perfect). NB most of these trips were "same day" (no overnight stay) or only a one night stay. Also not, we are nowhere near the 270 day maximum.

2. Do I really need to provide an original birth certificate for one of my parents? That's challenging as both of my parents are in NZ. Also, it asks for marriage certificate, however my parents separated 27 years ago, so is that really necessary? I'm not even sure if they could locate it - would that affect the application if they couldn't?

The MN1 guide suggests that the questions regarding grandparents (3.6-3.12) are only relevant for a section 3(2) application, which mine is not. Should we just not complete that section of the form?

3. Is it likely to cause any issues that I have never married my partner. (None that I am aware of?) The guide asks us to send a marriage certificate but obviously that will be missing.

4. What "evidence of residence" is required - should we provide similar evidence to the FLR M accommodation evidence?

Many thanks!
Andrew

As regards birth and marriage records, assuming that your parents were born in England/Wales and that they were married in England/Wales, you can get the birth and marriage certificates from the General Register Office.
