Can my Spouse apply for BC straight after ILR

Post by ILR_MN1 » Wed May 31, 2017 5:18 pm

Hi,

I was on ILR and just been granted BC. My spouse (who is on Tier 1 general dependent) is applying for ILR now.

I reed in the eligibility requirement for BC on this form that

If not married to BC, the standard requirements need to be met. This includes holding ILR/PR for at least 12 months before applying.

If married to a BC, you can apply the same day you are granted ILR if you meet the spouse requirements which includes 3 years residence. Any legal stay in the UK counts.

As I am now BC, can my spouse apply straight after ILR or does she needs to wait for 12 months.

Many thanks,
