Possible job move during naturalisation

Post by Ninin » Fri Jun 02, 2017 11:02 am

Hi –
I have recently handed over my Naturalisation application.

This week I just got the opportunity to apply for a role in a multinational company.
If the application was successful I may need to divide my time between the UK and another EU country I can choose among a list of possible locations, with a view on possibly moving abroad completely in 2018.
For the time being I would keep my residency in the UK.

I may need to take a decision soon at this regard.
Would this job’s move have an impact on my Naturalisation process?
Would I need to communicate this to the Home Office?

Thanks for any advice and help.

Details on the future intentions requirement are in Annex F to Chapter 18 of the Nationality Instructions.
https://www.gov.uk/government/uploads/s ... annexf.pdf

While an applicant for naturalisation should not normally have already decided to leave the United Kingdom permanently, it is not a requirement that the applicant promise never to do so. Nor is an intention for extensive business travel- returning to a United Kingdom home- in contravention of the requirement.

In addition- unless your existing nationality is EEA/Swiss- you may need a work permit to perform the role expected of you in the other EU state. (a permit not needed by British citizens- although that may change in 2019).

Thanks for your reply and for sharing the relevant document.

My question at this point is if I need to communicate to the Home Office the job's move (if it happens) since I won't change my UK residence and I have already sent all the documents for the naturalisation process.

I am a EEA citizen so I won't need a work permit.

Thanks again.

Others may want to comment in more detail, but employment details are requested as part of form AN so it may be expected that any change in employment would need to be advised to the Home Office.

If you have no intention to leave the United Kingdom to live elsewhere, then there should nothing to advise regarding the future intentions requirement. Note from 2.2.7 of Annex F:

2.2.7 If applicants make it clear that, while they intend to live in the United Kingdom for a period, they have made firm plans to establish their principal home abroad at some future date (e.g. to take up employment abroad for a foreign based firm), then we would expect to refuse the application. We should not normally refuse an application, however, merely on suspicion that the applicant's circumstances might change at some time in the future (e.g. they might decide to retire abroad).

If you have a British spouse and are applying under section 6(2) of the Act- the future intentions requirement does not apply.
This is not intended to be legal or professional advice in any jurisdiction.
