Second Masters on Tier 4- 6 year cap

Post by Lele9006 » Sat Jun 03, 2017 8:35 am

Hi,

I completed a 4 year bachelors at a Scottish Uni and then a 1 year Masters at a London uni.

I have read that a 4 year degree means you are eligible for a 6 year cap on the Tier 4 visa. I have been out of the UK for about a year, however. Would I be able to go back to the UK to finish another 1 year Master's course?

I believe I have 5 years and 4 months of leave, but if I'm under the 6 year cap could I return to the UK to finish a 6th year? And would I be able to file an application from outside the UK?

Thank you for any information! Feel free to ask questions if you need more information as well!

It's a question for your Tier 4 sponsor, but the relevant immigration rule 245ZV(ga)(i) appears to allow it:

the applicant has successfully completed a course at degree level in the UK of a minimum duration of 4 academic years, and will follow a course of study at Masters degree level ... and the grant of entry clearance must not lead to the applicant having spent more than 6 years in the UK as a Tier 4 (General) Migrant, or as a Student, studying courses at degree level or above

The guidance for sponsors about the cap is para 5.58 of the Tier 4 sponsor guidance, document 2:

I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
