Visa for my Turkish partner

Post by sammy1margaret » Sat Jun 03, 2017 2:28 pm

Hi all,
I am hoping that someone can help me regarding my Turkish partner.
I live in England and he lives in Aydin in Turkey :(
We have been together for 1 year now and not spent a day without speaking to each other, as well as me travelling over there as much I can.
Things have become serious very quickly and now there has been talks about marriage, so obviously we want to live together permanently.
It is not an option for me to move to Turkey as I have a 10 year old daughter, which he understands and is willing to come to England.
However, I have no idea about the process regarding visas, what type that he needs, if it is possible? And what's the best way of getting him here so we can be together? Also do I have to be earning a certain amount?
So sorry about all the questions, we are in desperate need of help and advice.
Thankyou

You would either have to:
1. Marry in Turkey and apply for a Spouse Settlement visa. Visa fee Spouse Settlement £1,464 + £600 NHS surcharge
OR
2. Apply for a fiance visa and marry in the UK within 6 months and then submit a FLR(M) visa application. Visa fees Fiance £1,464 + £933 FLR(M) + £500 NHS surcharge

Both options would grant a 2.5 year visa, after which he would have to re-apply for further 2.5 year visa, until he has completed the 5 year period required for permanent residence (ILR).

As the sponsor, you will have to submit your most recent 6 months payslips + the corresponding bank statements as evidence that you meet the mandatory £18,600 p.a income level.

He will also have to pass the A1 Level English test from a UKVI approved test provider.

Thankyou very much for your help and advice.
But the thing that worries me now is that I do not earn over £18,000 As I only work part time.
Is there a way around this please?
Many thanks

Unfortunately not if applying for a fiance or spouse visa unless you have savings over £16,000 to make up any shortfall in earnings or you are in receipt of one or more of the following benefits:
Disability Living Allowance
Severe Disablement Allowance
Industrial Injuries Disablement Benefit
Attendance Allowance
Personal Independence Payment
Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme
Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme
bereavement benefits

If the present Government are returned to power after the General Election they plan to raise the minimum income level to above £18,600.

:(
Would it be easier if we did not get married and apply for a visit visa and go from there?
Then after that, if we then apply for a working visa, could they then take his earnings into consideration?
Sorry, we just want to try anything
Any easier way atall that would make it possible
Many thNks again

No. Only you as his fiancee or wife can sponsor his settlement visa.

He can apply for a visitor visa, but in order for the application to be approved he will have to show strong ties to his home country in order to convince the Case Worker that he won't overstay in the UK. He won't be able to switch to any other category of visa while he is in the UK as a visitor. A visitor visa is issued for no longer than 6 months.

A Tier 2 General visa enabling him to work in the UK requires him to have an offer of a skilled position with a company in the UK who are Home Office licensed Sponsors.

Thankyou,
He can show that he has strong ties to turkey.
Also, being offered a skilled position may be possible.
So in your opinion, would you not get married yet due to the financial problems with the spouse/fiancé visa?
What steps/process would you suggest in order for us to be together and live in England
Many thanks

Does he have a skill such as IT, accountancy, teaching, or healthcare? The job must have been advertised for UK/EEA workers with no suitable applicant being found before it can be offered to someone from outside of the EEA & Switzerland.

You can by all means marry, but at present you wouldn't meet the income requirements to be able to sponsor your husband for a settlement visa.

Apart from a Tier 2 General visa or a student visa (costing approx £10,000 per year in study fees) there is no other route. Your best option would be to increase your workings hours or change employment to enable you to meet the £18,600 minimum earnings level.

Thankyou very much for all your help and I have decided to try and earn extra income, as you believe that is the best option for us.
I am just wondering now, if they take tax credits and child benefit into consideration in order to make the £18,600 per annum?
Many thanks

No, these are aren't included in the income calculation.
