FLR FP as a PARTNER

hello there
i hope all of you are in good shape
i came to the uk on April 2014 as a student visitor
i had a 6 months visa
i then overstayed and then got religiously(islamically) married in a mosque to a British citizen
i have a marriage certificate
now i know that getting married religiously in a mosque doesn't mean nothing.
i have been with my wife ever since and now i live in scotland with her
we moved here about 7 months ago
now we went to a solicitor and he figured we should apply under FLR FP as a partner based on family life
now i am really attached to my in laws and i am part of their family
i have all proof that supports everything
now what i wanted to know is that what are my chances of success when applying considering the solicitor told me you might be asked to leave the UK and go back to your home country and apply from there which i don't want to do to be honest because where i come from (Algeria) takes ages to process the paperwork just for me to get married legally to my wife
has anyone been in this situation or does anyone know of someone who has
i need advice please
