One of my developers applied for Tier 2 visa. He is working for me for the past 4 years from home in Egypt.
He applied 5 days before his CoS expire and I offered him £23000 annual salary.
CoS expiry date: 13/05/17
Applied date : 08/05/17 (TLScontact center offcie)
Received confirmation email: 16/05/17 (Sheffield,UK)
Today he received his documents with a refused letter, saying that they couldn't find his CoS on the system and his salary is not appropriate.
We are planning to apply for administrative review, but I need help with few questions please:
For the CoS that we also can't find on the UKVI web site "it is not there anymore". Should we apply for new one and email UKVI to process it as urgent so we can submit it with the administrative review before the 28 days?
Or I shouldn't apply and attach proofs of applying date before CoS expiry to the administrative review from?
I can rise his annual salary to £24000 to meet the visa requirements as I didn't know anything about the appropriate salary requirement before. In the immigration rules appendix J, 2137 Web design and development professionals, Experienced worker can get £24,000. Is this right and enough for approval or I should change it?
Do you suggest that I apply for administrative review or I should start new application?
One last question, if I start new CoS do we have to go through the 28 days advert or I can use the old job advert I created (3 month old)?
