EEA Family Permit applying from outside the UK

Hi there,

I am a EEA National married with a non EEA national spouse. We are both living in my spouse’s country and intend to go back to the UK. As I understand, you can apply using the online system and the EEA national DOES NOT HAVE to be necessarily residing in the UK at that moment as long as he intends to travel with the non EEA national within 6 months of the application?

If this holds true, I wouldn’t have to go to the UK 3 months in advance exercising treaty rights as self-sufficient and then apply for the family permit.

She is currently working here and I will go back to school starting from the end of September. As of now, I guess I could qualify as self-sufficient but I need more advice on this. She will relocate to the UK to be with me but in order for her transition to be smooth, we need to provide our own work permits for her company. So our initial plan was to apply for her family permit and once we are both in the UK, I will apply for the EEA1 and she will apply for EEA 2 while the family permit is active.

Please let me know if this can be done.
