Tier 5 grace period?

Post by Ness03 » Sat Jun 10, 2017 9:58 am

Hi,

My Tier 5 youth mobility visa is expiring on August 13, 2017. I intend to leave the UK on August 25 to travel around Europe and return to the UK in September 10 for a flight back to Australia on the 13th.
I've read lots of different things on this topic but I'm looking for a more definite answer.
1.Is it advisable that I leave the UK before my visa expires then reenter as a tourist and then go on my European trip?
2. Is the grace period 28 days or 90 days and will this apply to me without having to leave before my visa expires?
3. I would have all the required documents to prove where I'll be staying in my short time in the UK and my return flight to Australia, is there a huge chance I'll face some negative consequences at the airport?

Please help!
Thanks

If you overstay you run the very real risk of not being re-admitted. There is no automatic grace period. The UKVI can exercise some leeway if you apply late for an extension of stay, but you won't be doing that. The date in your passport is the date by which you should either apply for some sort of extension, or leave the UK.

Okay, I understand. It was an innocent mistake making my travel arrangements without putting into consideration my visa expiry date. Would it be better if I were to leave after my visa expiry date but not re-enter the UK?

I do honestly want to abide by the visa rules and are trying to find a way out of my dilemma the easiest (and inexpensive) way possible.

Either way you need to leave the UK before your visa expires. I advise changing your flight.

What extension of stay do you recommend I apply for?

If I were to leave before my visa expires then return for a week (without reentering a few weeks later), would that be permissible?

Extension for what? You haven't said anything about extending your stay.

Yes, if it is for a genuine short visit.

I am asking if there is anything I can apply for to stay in the U.K. legally for 12 days after my visa expires.

And yes it would be a genuine short visit - just staying for the week before my flight out of the UK on August 25.

No, unless you make some sort of application outside the rules but that would be expensive and time consuming, probably best done with immigration legal advice, then would need to be almost immediately withdrawn to get your passport back to travel.

I would advise leaving the UK before your leave expires, then coming back as a visitor, with evidence that it is a short visit. Sounds like you might have to do that two separate times.

Alright, great.
After all this I think I'm changing my plans to re-enter in early September.
