Discretionary leave extension

Post by Abu78 » Sat Jun 10, 2017 10:17 pm

Hi, I'm new here. Really need some help with my visa situation.
My husband s discretionary leave was granted in March 2012 till March 2014 (1st time), then extended from July 2014 till July 2017(2nd time). My older daughter (3 years) has dependent discretionary leave with her dad.
My discretionary leave was refused since March 2014. I went to first tribunal and upper tribunal and again first tribunal. Till last week I received the court letter which says my appeal is dismissed. However the court letter seems very understood my situation and suggests HO to consider my discretion.
At the moment, I can either appeal first tribunal s decision again or apply as dependent when my husband extends his discretionary this month.
My question is can I apply as my husband s dependent when he applies his discretionary leave extension? Will my dependent application affect on his extension?

Thanks

Hi Abu78,

Your first port of call should be to contact a solicitor and discuss your matter with them. Even though this forum is extremely helpful, only an immigration attorney will be able to give you the best advice.

All the best!

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Hi, my husband is going to apply his extension without me as a dependent. He is preparing his application form. The form is very straight forward. But what supporting documents he can attach with his application?
And we are claiming housing benefit, tax credit and child benefit. Although he is allowed for all services which states in home office letter, we still have a little concern. In the application, there is a question about whether using any public fund. Should he attach an explanation stating he was allowed and we have gradually reduced the amount of benefits.
Thanks
