Partner Mexican coming to the U.K for baby to be born.

Post by morgan2652 » Tue Jun 13, 2017 12:45 pm

I met my partner in Mexico over a year ago. I was living in Mexico from January 2017 - May 2017 but returned home as i thought i was home sick, turns out i was 13 weeks pregnant. As i do not want to live in Mexico the only choice we have is for my partner to come to the U.K. I understand he can come on a visit visa for 6 months but he cannot work. I have tried to research about applying for a visa but i am finding it very confusing. I do not earn over the income required to apply as i have returned from Mexico and only had my small part time job that i had from when i was in university, so i do have an income just not the required amount. Does anyone know anyways around this or other ways to apply? We are engaged but did not want to rush having a wedding just for visa purposes. The baby is due the end of November. Any advice would be very helpful.

There is no way out of meeting the £18,600 minimum income level requirement for a fiance or spouse settlement visa. That's unless you have savings over £16,000 held in an accessible account for 6 months to make up any shortfall in earnings. Savings can be held jointly or by either applicant or sponsor.

In order to be successful in a visitor visa application, your partner will have to show strong ties to his home country in order to convince the ECO that he won't overstay. Although the visitor visa has a validity of 6 months, requesting this length of stay may flag up as excessive. For example, an employer is unlikely to grant a 6 month period of leave.

Also consider that it is not permitted to switch to any other category from within the UK, having entered as a visitor.

I had savings of £20,000 but my mother took it out of my name a few years ago as she was in charge of it. Although this is still my money and she is giving it back to me right now it is not in my name and has to be in my name for six months am i correct? Can anyone in my family sponsor him or does this have to be me?

The savings must have been held in your name for a minimum of 6 months. Also, without any income you would need £62,500.

3rd party sponsorship is not an option.
