Buying shares inTier2 Gen main applicants sponsor company

Hi,
I am Tier2 dependant on my spouse work permit (Tier2 sponsored by employer). Since I am able to start a company a dependant, I am planning to take 30-50% of shares in my spouse sponsor company. Is it Ok or am I violating the HMRC law? the law says main applicant can't have morethan 10% of shares in sponsor company.
