US citizen traveling back and forth to U.K.

Post by salvadoriblack » Tue Jun 13, 2017 11:22 pm

Hi All,

I'm hoping I can get some help with my questions concerning my boyfriend's ability to stay with my in London. We are both from Chicago, I have dual Italian- US citizenship and I will be entering London with my Italian passport and attending grad school for 1 year August 2017-18. Ideally my boyfriend would stay with me as much as possible. He has over 15k usd in savings, my parents are going to pay for my rent and I plan on working part time in London, so he was planning on following unpaid artistic endeavors over the next year or so. What would he have to do in terms of coming and going in order to spend the most time in London possible. I have a house in Italy we can stay in when ever necessary. We planned to return back to the US for at least a month in December, though for now we bought 1 way flight to London in August- not knowing exactly when we will return home in winter. Of course he can stay in Chicago longer over winter if need be.

Any advice would be Greatly appreciated!

As a visitor, your boyfriend is not able to spend more time in the UK in a 12 month rolling period than he is spending in his home country.

If the Immigration Officer at UK Border Control believes that he is residing here and isn't a genuine visitor, they will refuse him entry.

See the link below for the Immigration Rules regarding visitors.

Note in particular V4.2
b) will not live in the UK for extended periods through frequent or successive visits, or make the UK their main home;

Hello!

Thank you for your answer!

Do you also happen to know if the time outside of the UK would have to be in the US or anywhere outside of the UK?

For instance, lets say we go to UK mid August then we leave in Mid December (around 4 months). He stays in US for two months and another Month in Italy, would they let him back in UK in February and for how long?
Would the 6 month length restart or would he only be allowed to stay for two months, given the four months he stayed in UK earlier that year, or would be not let him back in at all because he hadn't been gone for a full four months?

Then, lets say he does leave for four months, after staying in UK for four months. UK August December- Outside UK December- March- then returns for two. After May if he leaves would the not allow him back in for 6 months?

He doesn't intend to work at all, and he will probably be travelling outside of the UK frequently during that year, but likely not travelling back to the US, besides in the winter, as it is too expensive.

I know this is complicated..
Any help or clarification would be much appreciated!!

What evidence of STRONG ties to his home country will he be able to show?

You will see in my previous post that frequent visits to the UK are likely to result in a refusal of entry.
