Hi all, please advise who knows:
I am stamp 4 EU fam holder, retained rights (5EU form approved in January 2016), got permanent residency card in July 2016. Want to bring my 15 years old son (Ukrainian citizen) live with me in Ireland. Will he be treated based on the same rights as me, or as NON EU (which means he has to enter the country on type D visa for family reunification). Applied for his type D visa last year in Kiev Irish Consulate, they granted him type C visa (presumably because I am Stamp 4 EU fam holder), but in Dublin GNIB they saying he has to enter on type D.
When you have residence card, do you exercise the same rights as EU citizen?

Any help highly appreciated!

Hi ,

You are not an EU citizen in Ireland and even if you get Irish citizenship you can only be Irish or Non Eu when you ordinarily residing in Ireland.

Type D visa : Long Stay Visas (More than 3 months) when you intend to stay more than 3 month


Type C visa: Short Stay (less than 3 months) Mostly for tourism ..

You must leave the country before your permission expires. It is against the law to remain here without permission. An extension will not be granted for tourism, to attend an event or any non-emergency or foreseeable reason.


Family members of eu citizen only can bypass this rule.. So your son need to apply for Type D in order to Apply for permit .
