ILR with unemployed leave of absence & motoring conviction

Post by Rkkhawaja » Thu Jun 15, 2017 12:11 pm

Hi!
I wanted to share my experience her because these boards helped me so much with my husbands ILR.

So my husband completed his 5 year route on a teir 2 visa in jan 2017.
He accumulated 12 points due to 4 speeding FPNs and was summoned to the magistrates court and given a 6 month driving ban along with some fine in feb 2016.
When we started compiling his application we noticed he had 2 unemployed leave of absences, one for 3 weeks another for 1 week, both taken between employements.
He previous employers also wernt able to provide any evidence of leave of absence.

Following are the documents we submitted
Employer letter
P60s of 5 years
1 month bank statement
3 months payslips
Life in uk test result
English test result
Proof of leave of absence of only the previous year by his current employer
A letter to the case worker attached in section 7. In section 7 we mentioned the driving ban in criminal convictions. But in the letter we said that the conviction was held out in the magistrates court, the offence was speeding and that we did NOT hold a criminal record and attached a recent CRB to prove that.

Our experience at the prenuim visa center:
Booked the sheffeild center for 8.50
Reached at 10!!!
Husband was told his application was going to be the last to be considered since we were late
At 1 his application was taken up by the case worker and he gave his biometrics
20 min later his caseworker called him to say his application was fine only needed record of prev employments.
10 min after giving him the record husband was called and his application was successful!!

I have spent MONTHS worrying about his court conviction and his unemployed leave of absence and lack of annual leave record! And the the end the caseworker dint even ask us about any of it. Took him 20 minutes to give us an ILR! All thanks to god!

So anyone out there worrying about it, feel free to ask me anything.
