Best route to U.K. for partner?

Post by XYZ789 » Sat Jun 17, 2017 9:30 am

I have complicated situation and need help -

I am from Armenia, came to UK in 2004 and married British woman in 2006. Now I have British citizenship.

I separated from wife in 2014 and share custody of daughter who is 9.

I met new lady in Armenia and when I went to visit her in 2015 we had religious marriage.

How can I apply for her to come to UK? What is best route?

Does it make a problem that I am still legally married in U.K.? I have full time job and own house so have money to support her.

Thanks

Until you have divorced (with a divorce decree absolute), you are unable to sponsor her for a settlement visa. Your religious marriage in Armenia won't be recognised under British law.

The only option is for her to apply for one of the Points Based employment visas or a student visa.
PBS Tier 2 - must have been offered a skilled job by an employer who is an approved Home Office sponsor

Student fees will be £10,000 per year, or more

I want divorce but my wife will not agree to divorce so now I am waiting for right time after separation but this is 5 years.

If my new partner comes to UK on points based visa will we be able to live together as couple and make life here together?

The employment list is very long, I will see if anything is possible this way, but it must take long time to read whole list!!

Thanks for advice so far...

Is your partner currently employed in Armenia? Does she have a particular work skill :?:

Until everything is sorted with my divorce, is it possible for her to come as tourist / visitor to U.K. for just 6 months?

In theory yes, in practice highly unlikely.

1. Red Flag: person on visit visa with husband/spouse/wfire/partner in UK

2. Red Flag: six month visit is not a visit, it's residence.

3. Red Flag: looks to ECO/IO that an attempt is being made to circumvent the immigration rules, and some sort of HR claim for LTR would be made in-country.

Too risky.

Providing she can submit strong ties to her home country in order to convince the Entry Clearance Officer that she won't overstay. This may prove to be a tough challenge considering she has a partner living in the UK.

Also 6 months is likely to be considered as too long.

Edit: Beaten by Wanderer...

If she did not tell about our relationship for visa application and reason to visit was for seeing friends? Is this possible?

I also considered looking for her to be Au Pair for family I know with 4 children - could this be a way to come to UK?

If she fails to declare that she has a partner in the UK she will be digging herself into a very deep hole when the time comes to apply for a settlement visa in the future. A false declaration in any visa application can result in a 10 year ban. :!:

I also considered looking for her to be Au Pair for family I know with 4 children - could this be a way to come to UK? No, as an Aupair isn't considered to be a skilled job and can easily be filled by an EEA/UK worker.

Thank you for all answers.

I think we must try to find way to get employment visa.

I work at catering company and have many foreign workers, perhaps I could see if it is possible for her to work there.

No chance, mate. Company would have to be licensed sponsor, she would have to be highly-skilled, and the company would have to prove no local or EU person could do the job first.

I agree with Wanderer. Tier 2 Sponsors come under strict regulations for hiring overseas employees.
