Transfer residence card to passport

Hhello all....brilliant forum. Need advice. Married to German husband for 12 years..on 2nd residence card which is due for renewal in Jan 2018. Prob is I filed for divorce in Jan this year but husband is refusing to sign forms and return them to court. My visa is on A4 paper but I wish to travel home and was thinking of reapplying for it to be transferred to my passport but of course husband won't support my application. ...any advice on what I can do? We have 3 children and still live together just co-parenting but the marriage has broken down...advice will be appreciated

You may qualify for Permanent Residence.

If he sent the form back, that may be a case that he has seen it, and can use that as a basis for applying for decre nisi, or get a proxy server to send it to him.

Thanks Oboe he's refusing to sign and send back the form (very stressful for me). Can I apply to transfer the residence card without his passport though andd just the current card and a copy of the divorce petition? Oh ok will try the proxy server then....many thanks again. He received job offer in November 2012 but didn't start work till Jan 2013 so would I be eligible for OR in November this year or would I have to wait till Jan?
