Child's immigration status before applying for ILR

Post by irfanzafar » Sun Jun 18, 2017 10:33 pm

I am on tier-2 visa issued in Oct-2014 valid till Oct-2017 with 4 dependents. Wife and 2 girls (UK born) having their visas valid till same date Oct-2017. I will apply for my new UK born baby’s visa along with my own application for changing employer (have got another job and will be applying in 2 week time). Once mine and baby’s visa is sorted, we are planning to visit our home country for few weeks in Aug-2017 before expiry of my dependent (wife & 2 girls) visas (Oct-2017). My question is:-

1) On return, my wife will apply her new visa but we are thinking to skip for both girls as we will apply for our ILR (5 years route) in Feb-2019. Thinking to save hard earned £2,600. Will it affect their (both girls) eligibility for registration after we (Parents) get our ILRs?

2) I have seen a post few days earlier that someone had issues about their UK born baby whose visa was not in line with her parent and called as over stayer by UKIV. But can’t find that post now. If anyone know about their outcome or similar experience please share with us.

Thanks a lot for your help in advance.

1. Overstayed child is entitled to register, if child is under 10.

2. Inadvisable.
