Discretionary Leave to remain

Post by London2001 » Mon Jun 19, 2017 12:36 pm

Hi,

I came to the UK at 13 in 2001. I didn't really know I was an overstayer until I had to go to Uni then my parents advised I was an overstayer! I got good A level grades and was given a place to study law.
I got lucky and actually completed my degree in 2010. My mother told me she attempted to make an application on the 7 year route when I was 20 but that looped was closed.
We applied as a family last year, 2 sisters were granted 2.5 years based on half of their life spent in UK but 3 members including me were denied, this was August 4 2016. An appeal was made later that week. We didn't hear anything back until Dec 2016 we were asked to provide more information by HO. This was responded to by our solicitor on 23rd December. We have heard nothing since.

Pls any advise will do.

Hi,

From my experience, Home Office tends to take 6 weeks to six months. In some cases even longer. My suggestion to you will be:

a. Ask your solicitor to chase the matter.
b. Ask your local MP for help. They can chase the matter on your behalf.

Key thing is here to have patience. Best not rush them.

I am in kind of same situation as yours. I came to UK
at age of 13 as well and spent half of my life already here.
I was planning to apply for discretionary leave to remain but since
I am above 25, the rule won't apply to me(as per my solicitor advice). Only thing i can apply under is 20 years residencey.

For more information check here :https://www.gov.uk/remain-in-uk-family/eligibility Go to Private life 10 year route.

I will appreciate if you could please tell me which rule under you applied and the possible outcome of the case.:-)

Thanks
