Application submission time and pension contribution

Hi Guys can someone please clarify below 2 queries:

1. Pension contribution - Is it mandatory for visa extn? My accountant never enrolled or informed me that the employees of my company were autorolled into pension contribution and as a result there is no pension given to any employees. Do I stand a chance in getting visa extended? Is there a resolution?

2.What is the deadline to submit the application is it 1 month before the expiry date or just before the expiry date is fine? For eg if visa is expiring on 30 July can I submit the application around 26th July or it has to be 1 month before the expiry date.

There is a condition that the jobs should comply to all UK regulations. So, strictly speaking, yes the job could be rejected. However, Pension enrolment is still being rolled out, so I doubt if the Case Workers are paying attention to it as yet.

Having said that, if you staging date is due, you should have enrolled your employees on pensions anyway. You will incur fines, etc. otherwise. So, better late than never, complete your enrolment and pay whatever is needed. Again, at this moment, I don't think HMRC is being strict or imposing fines as it is still new.

You can't blame your accountant. It is your responsibility and I am sure there is at least one letter that you would have got addressed to you as a Director.

To do an in-time application, the last day you can post your application is the last date of your visa.

ALL companies will receive a letter, informing them about the workplace pensions. You are responsible to deal with it as a director. I got it more than a year ago. See: http://www.thepensionsregulator.gov.uk/en/employers

There is no deadline. Apply before the visa expiry to avoid becoming an overstayer

I have enrolled mine now and staging date is 1st of August. Once the staging date comes I need to declare/confirm that all my eligible employees are enrolled. Contribution would start from August(all details are set up on NEST)

This is a legal requirement from the staging date (which is different for different businesses) so if your staging date has passed do it ASAP.

I do not think before your staging date , there is any issue
