I was on Tier 1 general and was refused ILR last year based on tax record not the same on HMRC. Tax record had been updated with HMRC and reflected before my admin review outcome. New refusal letter was issued and deception clause was removed but HO refused the admin review based on my previous mistake. I have started paying the tax debt.
I applied on family life and has been granted 30months on (10yrs route).
I will be 10yrs in August this year and want to apply for ILR based on 10yrs long stay but am not sure if I can still qualify due to failed admin review and if HO count it as a break. Although, the admin review letter stated I should apply within 14 days if I have any reason to still stay in the country and which I submitted within the 14days.
Am now confused if I should submit an application in August 2017 to get my ILR based on 10yrs long stay instead of spending 10yrs on family life before getting ILR. (my children and wife are now British).
Student Visa: Aug 2007-2008
Post study visa 2008 – 2010
T1 Gen 2010 – Feb 2016
ILR submitted 10 Feb: 2016 but refused 05:May 2016
AR submitted 13 May 2016 but refused 21 June:2016
Family route submitted 30 June:16 & granted April 20, 2017
Should I go ahead and apply for ILR in August 2017 (10yrs long stay)?
Kindly advise and thanks in advance
