FLR M extension

Post by sk1984 » Sun Jun 25, 2017 11:11 am

Hi,

My wife is pregnant and she is willing to deliver baby back in India. Problem is ,her Spouse Visa expires on
Feb 2018 and baby is due to be delivered around 8th Oct 2017. As per HMPO, there is a minimum turn around of 16 weeks for baby passport applied from abroad. So I am not sure based on current timeline if we would get passport before my wife's spouse visa expires. My questions as follows :

(1) Can I apply for Indian passport for child and then apply for ROA or COE. Would this create any problem with Indian immigration authority while we exit country. I am not sure if we are eligible to apply because India does not allow dual nationality.

(2) In worst case if child passport does not come before Mid Feb we are trying to apply for a same day FLR (M) and then my wife would go back to India and come back when child's passport is approved.Reason we don't want to apply for fresh entry clearance application from India is because my wife is already employed and we don't know what happens to her employment after visa expiration. Is it OK to apply for FLR(M) as we are entering country for extension although with a genuine intention of staying in UK,would there be further scrutiny or query. We are going to honestly explain our case in details.

I do understand simplest option is to give birth in UK but due to lack of family support back in UK we are reluctant.

Father : Naturalised UK Citizen
Mother: Indian
