UK Visitor Visa Rejected.

Post by Harpzs » Sun Jun 25, 2017 5:52 pm

Hi all my first post,
My brother in-laws 6 months visa was refused and this was the reason from the visa officer.

-You wish to visit your sister in the UK for three months and that your sponsor intends to fund your trip. Whilst i am satisfied that your sponsor has adequate means to cover the cost of your proposed trip however you are required to satisfy me of your circumstances in india. I have therefore considered your own personal circumstances separately from those of your sponsor.

- You state on your visa application form that you are self employed farmer and that your monthly income is INR 30 000. As evidence of this you have provided an affidavit from your father, land documents, fathers bank statements from xxxx Bank of commerce and your joint account with your father from xxxx xxxx bank. However none of these documents are independently verifiable and confirm your income as stated. I am not satisfied that this is an accurate reflection of your means.

- In addition, based on the evidence submitted I am not satisfied that your Personal economic standing in india is established as claimed. I note that your joint account from xxxx xxxx bank does not show how much of the funds showing are for your personal use. Also the account shows a closing balance of INR *******as of 20/05/17. No evidence to confirm your financial situation has been made available. This leads me to doubt that on the balance of probabilities, that you have sufficiently economics ties in india to demonstrate that you intend to leave the UK on completion of your visit.

- i recognise the importance of family visits such as this however in light of all the above. I am not satisfied that you will leave the UK at the end of your visit or that you are genuinely seeking entry for a purpose that is permitted by the visitor routes and will undertake any prohibited activities set out in V 4.5- V4.10.

The ECO doesn't believe that your brother-in-law has strong ties in his home country sufficient for him to return without overstaying in the UK.

He will need to submit stronger evidence of his financial stability. This is more important than proving that you will support his visit.

So he needs to show he has a job and a bank balance.
They have land that is being rented and they get income from it.
Does the land have to be in his name? AT the moment it is all on the dads name.

If the land is only in your father's name this won't convince the ECO your brother-in-law has sufficient reasons to return. His father could easily transfer your BIL's share of the rental income to the UK

Had visitor visa refused for my parents and they are university lecturers with lots of ties to their home country. So just wife and kids will not be enough. My parents only wanted to attend my brothers graduation ceremony.

They will think he will come and stay with you and will not return back. It is possible to earn money in UK and support a family in a different country.
