Hi metanoia, thank you for getting back to me.
I just have a further question about Appendix 2 (VAF 4A December 2013) Financial Requirement form:
On Question 1.25 Do you and your sponsor have any shared financial responsibilities? Put a cross (x) in the relevant box >>>>>>>>>>>>, I'm not quite sure how to answer or approach this question.
My situation is below:
My then partner (now husband) lent me a loan which I was paying back to him a fixed regular amount every month. I didn't have too but I insisted I do it like that. Even before my work had ceased, my husband had been telling me to stop paying him back. With still 5 months left to pay, I stopped paying him though only this April. He is also going to fully support my visa application with himself being my sponsor. Is a loan like this considered shared financial responsibility and so I must answer "YES" to question 1.25? In addition, when I moved in with him, we told the local council that he's no longer just living on his own at his rented place (i.e cannot avail anymore the council tax discount for living on his own) and so I've got my name on the council tax bill although it's still my husband who pays for this council tax bill. So considering this and even with my name on the bill, am I correct in answering "NO" to this question 1.25? The council tax bill is among the documents we will show to prove we have lived together in a relationship akin to marriage at any time (question 1.19 of the same form).
Also, my husband will be providing his 6 month's worth of bank statement (01 December 2016 until 26 June 2017 to be exact). And in there, the loan repayment I was making to this account of his are recorded. Am I correct in thinking then that in the letter explaining the origins and timings of deposits NOT in keeping with account history, these regular monthly payment of the same amount are NOT considered NOT in keeping with account history because these are regular payments shown in each of the months covered in the said bank statements?
Do we need to explain in the letter above small amounts (£43, £95) I transferred one-off to my husband's account? The £95 for instance was the amount I insisted I transfer back to him as contribution to the cost incurred when he collected me to move in with him. My husband paid the combined van hire fee and deposit of £200. As another question, are transfers like these considered shared financial responsibilities and hence a YES answer to question 1.25?
Hope you can help provide guidance to the above. Thanks so much.
