10 yr ilr while waiting for previous decision from HO

Post by im2017 » Tue Jun 27, 2017 10:39 am

Hi All,
This is my first post, but been reading the forums pretty regularly and find them very useful.
I have not received my tier1 50k extension as yet, while my ten years requirement is fulfilled last month.
Can i apply on top of my other application? If so, can i apply over the counter as i have not received any passports yet?
Lastly I have my wife as dependent.Do i need to apply with 18,600 income limit .
If so can i use last 6 months payslips as i will be applying on basis of both partners income combined to 18,600.
Also does she need to do english test as well as she has no UK degree.

Thanks in advance as the question is too long.

You must vary your previous application to SET(LR) but you will not get a same day decision.
After you got ILR, your dependants have to switch to FLR(M) and you need 6 months income proof, which you both can share.

She also needs to prove her knowledge of English at level A2, so she needs to sit IELTS Life Skills – A2 Speaking and Listening.

You are indeed great zimba88 for replying so quick.
Just to clarify one thing that my dependat visa expired with me and have sent both visas for tier1 extension and have not heard anything back as yet.
So in this case do i apply together or apply alone first and then apply for her.
Thanks in advance.

In this case you must submit variation of the dependant to FLR(M) too

Application can be varied on the counter, but you will have to pay the full fee and then seek your refund later on.

Just wondering if i get a refund for my previous applicationas its still undecided and pay full fees for variation applications.
If i get a refund, what is the process for that. Is it through cheque or automatically in bank.
And do i ask them for refund or they themselves realisethat.
Thanks all in advance for help.
