British citizen - giving a birth in Slovakia

Post by ladybird22 » Thu Jun 29, 2017 10:22 am

I am a British citizen planning to give a birth in Slovakia and also stay there for couple of years. I would like to receive Statutory Maternity Pay (SMP) from my current employer. I am confused how it works with the health insurance in Slovakia once the certificate S2 (which will cover me and baby until 15w after the birth) expires? Can I apply for residency and health cover while still getting SMP from UK? Any advice, thoughts are much appreciated.

Statutory Maternity Pay: https://www.gov.uk/employers-maternity-pay-leave
Is it ethical to claim SMP from an employer if you have no intention to return to work with that employer?

Residence in Slovakia: https://ec.europa.eu/eures/main.jsp?cat ... SK&living=

Child born in Slovakia will be British as long as you (or the other parent) are British otherwise than by descent:

I can claim SMP even If I resign from my current employer (as long as it is 15w before due date at earliest) as I am legally entitled to it. I can decide whether I want to return to work anytime during my maternity leave,no? Maybe there is no difference between resign or stay employed in case I really do not plan to come back...?

My and my partner both became British citizens by naturalization few years ago - so I suppose our baby will be British when born in Slovakia.

Appreciate your response.

Child should be British by descent.

Out of interest- if you and/or your partner are originally Slovak then you may want to look into how the 2010 law on restricting Slovak/other dual citizenship affects your situation. If you're solely British- you'll need to watch how the projected withdrawal of the United Kingdom from the EU in March 2019 will affect your status in Slovakia.
