Travelling without spouse - on a Schengen visa spouse of EU

Post by shiju31 » Thu Jun 29, 2017 6:28 pm

My wife have a Schengen visa valid for 6 months and this have been issued on the basis of Spouse of EU citizen with Remarks as 'Family member of EU/EEA" from French embassy.

I will be travelling 'with her on France on a first visit, however i would like to know would she be able to travel again from UK to other schengen country without EU spouse on her second visit?

I guess she might have to carry marriage documents and EU spouse passport copy, however, would they still deny entry as she got visa based on spouse of EU visa and spouse is not with her.

She can as " a family member accompanying or joining a EU national ". She has to be able to prove you are already in the EU and she is coming to join you. Say if you are already in France at that time but she has her entry in Spain (for example it was a cheaper ticket) that is also fine. If you are not in EU then she cannot travel on her own because the basis of that visa being issued free of charge was because of free movement rights of an EU national.

Yes they can. The first thing any border guard asks when they see "family member of EU national" on the visa is where is the EU national. If there is no EU national in the context of accompanying or joining, she can be denied entry.
