Working temporarily for an overseas subsidiary on Tier 2

Post by SDNDM » Fri Jun 30, 2017 2:07 pm

Hi all,

I have tried to find answer all over the internet and could not get a satisfactory answer.

I'm on tier-2 visa sponsored by a reputed UK company. My company started an Indian subsidiary couple of years ago. This subsidiary is registered in India as PVT. LTD company and a subsidiary of a UK company. Two of staff members of this subsidiary left job unexpectedly last month.

Last week my manager asked me to go and work at this subsidiary company for 2 weeks in July and then another 2 weeks in November. This will help calm down things and finish some left over work from ex-staff members.

I will do exact same work (Software Development) in India. I will still be paid from my UK employer, UK salary, will pay UK tax. The whole trip is company sponsored. My UK company is paying for accommodation, food and travelling.

My Questions are:
1. Am I allowed to do this on Tier 2 visa?
2. Do my employer or I need to let Home Office know about this?
3. When I apply for ILR in a year time. Do my employer need to explain purpose of these visits on absences letter to Home Office.
4. If yes for question number 3, then should they regard this as a business trip, secondment or working remotely.

Many thanks.

Like iworker said, There's nothing wrong in that and you don't have to inform HO. You are working for the same company and only going to India on a project or business trip (working abroad) for a short time.
The most important thing is that you are working for your sponsor, earning money in the UK and paying your taxes within those short periods you were away. If there are extra allowances for working abroad, your pay slip will show that, if not, it's ok.
You sponsor will also be able to verify your absences when you apply for ILR.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
