Double Descent

First, I apologize if this question has been asked previously. I was not permitted to use the search function.

Ok, Me British Citizen, born in UK, moved to US in 1986. My parents are British, and my grandparents are British for generations :) I Have two sons - both born in the US and who hold British passports/dual US/UK citizenship.

We are all thinking about moving back to the UK. However, one son is married to a US citizen, and they have a daughter, my granddaughter, who is a US citizen. Is my granddaughter eligible for citizenship by double descent?

Not automatically.

However, if her British citizen by descent father has lived in the UK for three continuous years at any time in the past, your grand daughter is entitled (i.e. cannot be refused) to be registered as a British citizen before she turns 18 (Section 3(2) of the British Nationality Act 1981)

Alternatively, if she moves to the UK with her British citizen by descent father and resides in the UK for three continuous years, she is also entitled to be registered as a British citizen before she turns 18 (Section 3(5) of the British Nationality Act 1981).

As the US is not a Commonwealth country, your grandchild won't be eligible for an Ancestry visa in the future either. So, if she is not registered before 18, there will be no easy way to claim British citizenship based on your British citizenship.

If he plans to bring his wife and daughter to the UK, your British citizen by descent son will have to demonstrate that he has a salary of atleast £22,400 per annum for at least a year already AND that he has a job offer for the same amount in the UK. Alternatively, he will need to show savings of at least £72,000 held in an accessible bank account for at least six months.

My granddaughter is three years old, and no, my son lived in the Uk for just a year. So there goes that!

Well, the good news is at this point we have 15 yrs to get her registered- unless the law changes. I am sure he wishes he has 72k hanging around in the bank. The job with 22K salary here in the US isn't an issue-getting a UK job may be, primarily because of logistical issues. I may have to go with him and then he can bring his wife and child when able. Stinks to separate families, I doubt I am the first, and wont be the last.

Is there anyway that allows me to "sponsor" my family? I am definitely able to support all of us.
