Non-EU citizen visa/EU1 residence card

Post by Christinafhughes » Sun Jul 02, 2017 6:23 pm

Please someone I need advice.

My husband is an EU citizen. Irish passport born and raised. I am an American Citizen
Though he resides in Northern Ireland
My daughter was born in Northern Ireland and I have another soon to be born in Northern Ireland
My daughter has gotten her US passport and we will get her Irish passport soon.
Do I need an "Irish" residence in order to apply for an EU1 residence card or can I apply with my husband residing in the "North"? I entered last via Dublin in February 2017.
Please help. And thank you! So very much.

Hi Christina,
Good Afternoon.

From the information that you have provided it emerges that you are living in Northern Ireland from February 2017 and you entered from Dublin port?

Considering the fact that your baby was born in Northern Ireland to you (an American mother) and an Irish father the child is also Irish by birth. Can you please advise if your husband is in direct employment or self-employed in Northern Ireland (United Kingdom)?

Secondly, can you also please advise when you entered the UK (NI) during the time of your baby's delivery what was your immigration status? i.e.: were you on a visitor visa in the UK or on a EEA family permit?

Finally, where do you guys as a family intend to reside/ settle. As you gain your rights to residency in the UK or the Republic of Ireland on the basis of your husband and his exercise of treaty rights.

I hope the above helps.

Thank you,
Best regards,

Aaron.
