Hi every one,
Thanks for the great content on here, this community has really helped throughout my application process.

This is my first time posting and would love to hear some of your opinions / experiences with the EEA Extended Family Member Visa as an Unmarried Partner. I have been given a COA without the right to work.

I have no idea what my next move should be! My Current Youth Mobility Visa Ends on August 17th 2017 and on phone calls to the HO they say that I don't have to leave the UK while my application is pending. However, I have read on other post in this forum that could make me an overstayer. Has anyone else been in a similar position?

I was also told over the phone by the HO that if I leave the UK while I have an application pending that I could run the risk of having it declined on the basis that I left the country.

Now I am unsure if I just have to sit and wait in the UK for 6 months without being aloud to work while I wait for the application to process.

If can't work I would like to get my passports back and make the most of the summer and travel some of Europe.



In summery I would like to know two things:


1) Can I stay past my current visa with a COA?

2) Will leaving the Uk while I wait for a decision on the EFM visa effect the outcome?


Would love to hear everyones thoughts.

A little bit about my application:

My partner is a dual national Australian/German, we have been together all most 3 years.
We both met in Australia and decided to move to London together. I came over on a Teir 5 Youth Mobility Visa and she had her German passport. We have decided to try stay for an extra year past the two years given to me on the youth mobile visa and have went down the EEA EFM route.

My current Tier 5 Youth Mobility visa ends on August 17th 2017.

Dated submitted the EFM application : 3/5/2017

Date payment was taken: 8/5/2017

Biometric invitation and COA without right to work received: 28/6/2017

Biometric scan submitted: 29/6/2017

Passports requested back: 30/6/2017

1) You can stay even after your mobility visa expires, but you can't work because as an EFM you only get a CoA without right to work. The problem comes if your application gets refused, as you will become an overstayer.

2) You can leave the UK as long as your mobility visa is valid (and of course if you request your passport back). If you leave the UK after the 17th of August you may encounter problems to enter again.

Hello Jaredg,

Have you got your Residence Card yet? I'm in a similar situation like yours. I applied for the EEA EFM RC in June and got mail from HO for the biometrc enrollment in which it enclosed the COA with no right to work. But my current short term visa expires on 16th of Sept. I dont know what to do now. Did you remain in UK after the expiry of your Visa? Or you went away and came back? If you went away, what happended to your application?
