Going to India during pregnancy

Post by ashoknairs » Mon Jul 03, 2017 6:44 am

Hello,

My name is Ashok and I am a BRITISH Citizen by naturalisation. My wife is an Indian and on spouse visa working in The UK ( 2 nd extension of two and a half years). She came to The UK in December 2009.She is pregnant now with our first baby. We are planning to go to India for the pregnancy. She will be staying in India for one year. She has got spouse visa till March 2019. She will be going to India during her 25th week of pregnancy.

The reason for our decision is my wife is 34 years and this is her first pregnancy. Moreover she wants to be with her family during the whole period of pregnancy and delivery.

My questions are ----

1) Will there be any problem for my wife to get ILR?
2) What is the pocedure for the baby to get BRITISH CITIZENSHIP ??
3) Will there be any problem for my wife and baby to come back to The UK ??

Please advice.
Many thanks for your time.

Regards,
Ashok.

What date does your wife intend to return to the UK? Are you aware that she will be unable to apply for ILR or a FLR(M) extension from outside of the UK :?:
(Casa, not CR001)

@ casa she has visa till march 2019, so going out for a year should be fine and should be ok to come back?
There are currently no requirement for abseses outside the uk to get an ilr on spouse visa. however getting nationality will be a problem as that has a criteria of max number of days spent outside.
