Hello I am a 24 year old woman who is a British citizen from birth. I have been with an illegal Albanian man for over a year and we are both very serious about making this work. However I am raising my children alone due to their father not being involved. My partner helps all three of us. I rely on state benefits because they are both disabled. What requirements must we have to gain permission to marry? We do not want this right now but it has been a serious topic we have talked about for the past two months. We both love each other and he fits in amazingly to my family, he is a great step father. I have read many articles about the British citizen having to earn 20.000 a year to gain permission to apply to get married. This is not manageable given my circumstances which will never change due to my boys additional needs I will be out of work for some time. Any advice would be appreciated.

In order to marry in the UK you would have to register with a Home Office approved Registry Office. The Registrar is then legally bound to notify the HO, who can then extend the notification period from 28 to 70 days in order to interview you both separately should they choose to do so before the wedding can go ahead.

As your partner has no legal status in the UK, he risks being detained on the day of the interview.

If you are permitted to marry, he will be unable to submit a spouse visa application from within the UK and will have to return to Albania and apply from there.

Are you claiming Carer's Allowance?
