Is there a UK visa akin to 'overseas Citizen of India' (OCI)

Post by SPILR » Thu Jul 06, 2017 10:17 am

Hi, The situation is as follows:

Indian passport holder obtains British Citizenship, then obtains an OCI visa to India.

Moves to India and lives in India with OCI for 5 years, then applies for an Indian passport again. Obtains the Indian passport.

Question - As India does not allow dual citizenship, the person would then have to renounce his British passport. At this stage, is there an option to obtain some kind of visa (similar to OCI) for the UK, to be able to have permission to live/work in the UK with the new Indian passport; just as OCI holders have in India (whilst holding a British passport)? Obviously, I mean an option other than going through the 5 year settlement route again.

Thanks

British citizens are entitled (i.e. can not be refused) to be re-registered as British citizens if they renounce their British citizenship to gain the citizenship of another country. But this entitlement can be exercised only once.

Section 13 of the British Nationality Act 1981

In order to reside legally in the UK, one needs to have either the Right of Abode(mainly British citizens), leave (either limited or indefinite) granted under the Immigration Act 1971 or to be exercising rights under EU law.

If you have renounced British citizenship and wish to retain Indian citizenship, the only option is leave under the Immigration Act 1971. But such leave can have conditions and almost always require residence (not just physical presence) in the UK.
