Unusual question about returning to Germany.

Hi,

2015 - 2016 we lived in Germany. I am an EU citizen my partner is not an EU citizen. We are married. He got his Aufenthaltskarte and everything was fine. We have since moved to the UK where he now has his residence card and we both have a job. We miss Germany and are thinking of moving back. Will he now need to apply for a new Aufenthaltskarte, since we have been outside of Germany for almost a year now. His Aufenthaltskarte is still valid, well the date on it has not expired.

It doesn't matter if the residence card is valid or not, that is not a concern at all. After having lived for a year in UK you shall go back to germany through SS(if you are a german citizen) or just on the conventional basis of 2004/38. The point is your spouse has rights through you and the card is just an endorsement. If it is valid, good use it, if they come up with a notification that they have revoked the permit apply for a new one. In any case your spouse has equal rights on par with any other EU national with or without a card by virtue of being a spouse of a qualified EU national.
